“Kommersant”: Cabinet approves dismissal of criminal cases when paying tax debts

MOSCOW, February 21 – RIA Novosti. The government commission approved amendments to the Russian Criminal Code, which should exclude criminal prosecution if the entrepreneur has fully paid his tax debts and penalties, writer The Kommersant newspaper cites a source from the government.

“On February 20, the Commission on Legislative Activities of the RF Government approved amendments to the Criminal Code (CC) aimed at liberalizing criminal liability for offenses related to tax evasion. As expected, the Cabinet should approve it at the next meeting on Wednesday, a source from the Government told Kommersant from now on. He then said that the bill would be submitted to the State Duma.

According to the publication, the changes oblige the authorities to make a decision to refuse to file a criminal case or end the case if the entrepreneur comes out of the shadows and fulfills all tax obligations.

Also, according to the newspaper, prosecution periods for tax evasion should be reduced from ten to six years.

In early February last year, Ekaterina Avdeyeva, head of the Delovaya Rossiya expert center for criminal law policy and enforcement of judicial proceedings, raised the relevant issue at a meeting with President Vladimir Putin. In April, Putin, with Delovaya Rossiya in attendance, instructed the government, the Supreme Court, the Attorney General’s Office, the Investigative Committee and the presidential administration to look into the matter.
