Ukrainian Foreign Minister Kuleba: ICC cannot apply the “aggression” clause against Russia

MOSCOW, AUGUST 3 – RIA Novosti. Ukrainian Foreign Minister Dmytro Kuleba said that the International Criminal Court (ICC) cannot apply the “aggression” clause against Russia.

“The statute of the (International Criminal Court – Ed.) states that one of the crimes it can prosecute is aggression. But in practice, for purely legal reasons, it cannot specifically apply this article to the case of Ukraine and Russia,” said Ukrinform.

According to Kuleba, there is a problem of institutional egoism both in the issue of the International Criminal Court and in the establishment of a special court. The Minister believes that Ukraine’s partners urged not to create a special tribunal, as there is an ICC, so as not to create an alternative.

“More importantly, is it the interests of the ICC that does not want a temporary alternative to itself, or the justice that the ICC exists? There is a surprise here, because they are on the side of both justice and the ICC.” The Head of the Ministry of Foreign Affairs of Ukraine announced.

Kuleba had previously said that he would ask the Prosecutor’s Office of the International Criminal Court, the European Commission and the Dutch government to create a special international court for Russia. In response, Deputy Chairman of the Federation Council Konstantin Kosachev stressed that Ukraine’s attempt to create a court for Russia lacks an international legal basis.

Since February 24, Russia has been conducting a special operation to navy and demilitarize Ukraine. Vladimir Putin described his mission as “protecting people who have been subjected to eight years of bullying and genocide by the Kyiv regime”. According to the president, the ultimate goal is to liberate Donbass and create conditions that guarantee Russia’s security.
